Warranty for Goods, Product warranty

1.     In case of a defect in the ordered product, the buyer may assert a warranty claim against the Provider according to the provisions of the Civil Code. During the enforcement of the warranty claim, the buyer may request the repair or replacement of the defective product, except if the repair or replacement is impossible or would involve disproportionate additional costs for the Provider. If the buyer did not request or could not have requested repair or replacement, they may request a proportional price reduction, repair the product at the Provider’s cost, or withdraw from the contract if the Provider did not undertake the repair or replacement, was unable to perform it, or if the interest associated with the repair or replacement ceased. The buyer is responsible for providing substantial proof of interest cessation. Withdrawal due to a minor defect is not applicable. The buyer may switch from one warranty right to another; however, they must bear the cost of the switch unless it was justified or the Provider gave reason for it. The buyer is obliged to report the defect immediately after its discovery, but no later than two months from the detection of the defect. Warranty claims cannot be enforced after the two-year limitation period from the performance of the contract. Within six months from the performance of the contract, enforcing the warranty claim requires only the communication of the defect and the presentation or sending of the invoice or its copy. After six months, however, the buyer must prove that the defect was present at the time of performance.

2.     Instead of a warranty for goods, the buyer may also enforce a product warranty claim against the manufacturer or distributor. In the case of product warranty, the buyer may only request the replacement (or repair) of the defective product. The product is defective if it does not meet the quality requirements in force at the time of distribution or if it does not have the properties described by the manufacturer. In this case, the buyer must prove the defect. The product warranty claim can be enforced within two years from the date of distribution. The manufacturer/distributor is only exempt from the product warranty obligation if they prove that the product was not manufactured or distributed as part of their commercial activity; or the defect was not recognizable at the time of distribution based on the state of science and technology; or the defect of the product arose from the application of a law or mandatory regulatory prescription. The manufacturer/distributor only needs to prove one reason.

3.     Warranty for goods and product warranty claims cannot be enforced simultaneously.

 

WARRANTY ENFORCEMENT

If the product purchased from us is incomplete, has a manufacturing defect, or is damaged, please notify us via email as soon as possible to discuss the method of product exchange or repair.

The enforcement of the warranty is only possible if there is a manufacturing defect or deficiency! The warranty obligation does not cover faults arising from damage, improper handling, use, or external impacts!
